It is a "firearm" by definition and there are no laws saying it is illegal to add a vertical foregrip to a "firearm". So if an AR is at least 26" long and does not have a shoulder stock then it is considered a "firearm". And because it is a "firearm", and not a "pistol" or "rifle", a vertical foregrip can be added.

If you attach a vertical forward grip its now an sbr and therefore, illegal unless you get your stamp. If you affix a stock, its now illegal unless you get your stamp. You can turn an ar pistol into a rifle by adding a 16inch or longer barrel and a stock, but you cannot legally do the opposite.

You can put a magpul or other manufacturer Angled foregrip on and still be ok. Because they are not “vertical”, less than 90 degrees. They are like 45-50 degrees so no where near 90 so they are ok on the pistols without creating an AOW. You can take a pistol and make a rifle but not a rifle into a pistol.

The ATF decided that it is illegal to put a verticle hand grip on a pistol. They then defined a verticle hand grip as anything at a ninety degree angle to the barrel. On further questioning they have stated that things like the Magpul AFG is legal on a pistol. So...per the ATF most angled foregrips are legal.

But why would you need to ship it to a class 3 dealer for install of the grip. If you form 1 to make your pistol an AOW once stamp is in hand you can put the vertical grip on yourself. As goes for an SBR. The law is you can't have all the parts is your possession to make the gun until the stamp is in hand.

So my understanding of the ATF ruling is that vertical grips are not legal because it’s means that the gun was designed to be fired with two hands (two grips) and thus makes an AOW. However, AFGs are allowed.

While it might seem tempting to mount a vertical fore grip to your AR pistol, and while technically the law is silent on this addition, the ATF still takes a dim view of it and in the end, even if you are right, you will have to endure an expensive trial to prove it. 3.

The following letter from 2011 breaks down the ATF’s position: To summarize … unless your AR pistol has an OAL greater than 26 inches then you should not add a vertical fore-grip unless you first submit a Form 1 and get it approved.
