An AR pistol is any AR platform with a barrel shorter than 16” and does not have a rifle stock on it. Those are two very important characteristics that you should remember when checking your state laws to see if an AR Pistol is legal. A brace being fired as intended to be used per it's design.

The primary difference, however, is that an AR pistol cannot legally have a rifle stock affixed to it. As such, this platform is considered, by law, a handgun, and treated as such.

While it is legal to add a Stock or a Folding Stock to a pistol, doing so will create a SBR which must be engraved and approved using an ATF Form 1 prior to doing so. In fact, having a stock and a pistol in close proximity with the present ability to configure it as an SBR could be constructive possession of an SBR.

RE-10-A5SR_00.jpg. Yes. It's not a pistol buffer tube if it has the track. You can't put a conventional stock on it unless it has the track. A buffer tube costs little compared to the tax stamp and engraving for an SBR, so just change the buffer tube when the SBR is legally approved.

Pistol lowers are typically purchased and transferred as either complete guns or complete lowers. Jeff gave the example of a Smith & Wesson M&P 15 Sport. If the owner removes the 16-inch upper receiver assembly and stock to put on a 10-inch upper and brace, it becomes an AR pistol. “ [He or she has], in fact, just created an SBR,” Jeff said.

The pistol ar saves you time but cannot have a stock since it's considered a pistol, but you currently can use a brace to help stabilize it and shoulder it using the brace ( for now at least). The ar rifle is intended for primarily medium to somewhat long engagements 50 meters out to 300 or more depending on how accurate the shooter is and what equipment is mounted onto the gun.

But to reiterate, an AR pistol cannot use a buttstock. A brace, on the other hand, is an entirely different matter. A 2014 letter by the ATF determined that adding a brace to an AR pistol would not move it into SBR territory. A braced AR pistol would still be considered a pistol.

The ATF has also concluded that adding a stabilizing brace to a handgun does not make it a short-barreled rifle, unless the user configures the device for use as a shoulder stock, such as permanently affixing the brace to the end of the receiver extension to excessively increase length of pull, removing the arm strap, or some other modification that would reconfigure the device for use as a shoulder stock, and unusable as an arm brace.

As a matter of fact, you can even put an AR rifle adjustable buttstock on it. My dealer says that it’s still legal, but I’m not sure. Has anyone seen these? Are they within ATF guidelines for an AR pistol? It seems to me that it would be considered a sbr, but my dealer (he’s reputable and a cop, but not ATF) swears it’s kosher.
